sticky bug on faceted search if an option that returns less than the actual number of products is selected

the faceted search is overlaying the section bellow the listing instead of remaining within the parent boundaries, this only happens if an option that returns less than the total number of results is selected (in my case if i select anything that returns 43 products, everything is ok but if I select anything else then the sticky facets on the left become sticky even over the footer instead of being sticky just inside the parent container)
