element is unfixed before its real position

thank you for this plugin, i think I finally have it working on a wordpress site, I am trying to emulate the floating / fixed footer element that fades in and then sticks in place as you continue to scroll on this page: http://www.sungevity.com/.
I have mine fading in and sticking to the bottom, but disappears way before its actual position in the html.
I played with the test-min.html that comes with the download and moved is all over the place, even added more content before and after and it still works wonderfully, but not sure why it disappears / becomes non-fixed to bottom before it is suppose to with mine.
any help would be wonderful.
is it an offset issue?

I took a look at your website. Very nice! I did not see that the footer is using the scroll to fixed plugin. You might have removed it?
no no. it is on a working site that is not live yet.
actually local so far, as we are testing things before we go live.
stage.thatsbyers.com is the staging site, but i have it local, so it
is not on that yet as I cannot get it to work correctly.

Usually it is an offset issue. If it is possible for me to take a look, I might be able to see what the correct solution is.
