When die game starts on beginning

I using the cia on the N3DS XL.

I have the problem that when I die the game starts from the beginning

When that is a bug here my idea:

When the game loads data: the game saves the progress

When i die: the game loads the latest save

when you die, just hit start, then select save/load, then hit load, then load your game
