arc.cwl mandatory or not?

The description and depiction in the example ARC for the arc.cwl file seem to be contradictory.
The description states:
Furthermore, top-level reproducibility information MUST be provided in the CWL arc.cwl, which also MUST exist.
which means - to my understanding - the arc.cwl is mandatory.
But the Example ARC structure states:
arc.cwl [optional]
Not sure which one is correct here?
