More a remark than an issue: JOSM displays a warning dialog if a specific upload prohibited flag is set in an .osm file to avoid accidental uploads. See http://josm.openstreetmap.de/ticket/4043 for details. This might be of interest for ogr2osm …

ogr2osm sets this flag on all output files. From a file I made last night:
<osm version="0.6" upload="false" generator="uvmogr2osm">
