switching to sudo on a file bring "Buffer name `foo' is in use"

Using dired-toggle-sudo in a user buffer file fail with apply: Buffer namefoo' is in use`, but if done a second time it succed.
This doesn't appear in dired nor when switching back from a sudo file buffer to a user one.
