Javascript for extension loaded wrong

Hi!
I guess you are loading the javascript code for the extension in the event overall_footer_after.
Wouldn't it be better to use <!-- INCLUDE JS --!> for the sake of best practices?
That way I could know loading jQuery before {$SCRIPTS} in the footer would be the right way, and I won't have to load jQuery in the header for one extension :)
Just the thoughts of a theme developer!
