Out of Stock Simple Products that are not linked Configurable

I encounter a bug, on my catalog i have simple products that are visible on catalog and not linked to any configurable product, and i also have configurable products. If i have display out of stock product on my magento configuration and i also have Switcher Show out of stock configurations setting on, When i visit a product page with a simple product that is out of stock it will show the product as "in stock" and will also display the add to cart button, if you click on in then i give you the message that this product is out of stock.
any ideas why it will affect simple products like that?
