Iphone scroll deactivates modal but does not dissapear

The reveal works well on a browsers and phones tested except for IPhone 4 and 5 when you scroll with your finger it should either disappear or scroll but the background becomes active and it stays on top and can not be removed by click or other.
Android 4 scrolls then click outside and it disappears.
