昨今、多様な参加者が参加して共にアイデアをつくる「アイデアソン」、それをソフトウェアとしてつくる「ハッカソン」、さらに見たり、触れたり、感じたりできるものも含めてつくる「メイカソン」が盛んに開催されるようになりました。そうしたイベントでは、多様なスキルや視点、経験を持つ人々が競争することで知的財産が創出され、事業化に向けて進めていこうという事例もでてきました。こうした状況により、イベントの主催者や参加者間において、知的財産を適切に扱うためのルールが求められています。
また、参加の動機や期間中の貢献度、その後リスクをとって事業化まで進めていきたいと考えるかどうかは同じチームの中でも参加者ごとに異なります。時間が経過した後のトラブルを避けるためにも、終了後に参加者間で成果物とその後の扱いを確認し、書面で残しておくことが望ましいのですが、なかなか難しいというのが実情です。
そこで、主催者側、参加者側の双方にとって適切に知的財産を取り扱うことまでを盛り込んだ参加同意書、およびイベントが終了した後、その中での成果とその後の扱いをどのようにするか、公開時の成果物の扱いを確認する書類、およびその解釈を具体例で示したFAQを、法律の専門家である弁護士の監修のもと作成しました。今後開催されて行くハッカソンやメイカソンで、参加者と主催者、双方にとってイベントの成果物やそれに関する知的財産等が適切に扱われ、共創から新しいビジネスや産業が生まれ、持続可能な社会になっていくことを期待して、ここにテンプレートとして公開いたします。
なお、この同意書とFAQは、文部科学省・科学技術振興機構による「革新的イノベーション創出プログラム（COI STREAM）」にCOI-T（トライアル）拠点として採択された「感性に基づく個別化循環型社会の創造」（中核拠点：明治大学）、および、COI拠点として採択された「感性とデジタル製造を直結し、生活者の創造性を拡張するファブ地球社会創造拠点」（中核拠点：慶應義塾大学、グラント番号：JPMJCE1314）の一環として、参画機関の1つである情報科学芸術大学院大学［IAMAS］において作成されました。

In recent years, "ideathons" in which diverse participants create ideas together, "hackathons" in which participants create software, and "makeathons" in which participants create things that can be seen, touched, and felt have become popular. At these events, people with diverse skills, perspectives, and experiences co-creates intellectual property, and there have been cases of people trying to commercialize it. Under these circumstances, there is a need for rules to ensure that intellectual property is handled appropriately by event organizers and participants.
Also, the motivation for participating in an event, the level of contribution during the event, and whether or not the participants want to take risks and proceed to commercialization after the event are all different even within the same team. To avoid problems after a certain amount of time has passed, it is advisable to confirm what deliverables are and who among the participants will handle those after the event and leave the agreements in writing. However, this is not easy in reality.
Therefore, I have prepared, under the supervision of lawyers who are legal expert, a participation consent form that includes the appropriate handling of intellectual property for both organizers and participants, a confirmation form that confirms how deliverables will be disclosed and handled after an event, and a FAQ that provides concrete examples of how to interpret these documents. We hope that both participants and organizers of future hackathons and makeathons will treat deliverables and intellectual property appropriately in events, new businesses, and industries will be born from co-creation, leading to a sustainable society, so we publish it here as a template.
