What is an IP?

Intellectual Property is all about knowing your rights.

Intellectual property (IP) is a category of property that includes intangible creations of the human intellect. There are many types of intellectual property, and some countries recognize more than others. These are safely protected and controlled by well established statutary and judicial framework to provide qualitative help to inventors and creators of a product. World Intellectual Property Rights Day is seen on April 26 of every year.

Intellectual Property comprises of Two distinct forms:

  1. Literary and Artistic work
  2. Industrial Property

Literary and Artistic work

They are books, paintings, musical compositions, plays, movies, radio/TV programs, performances and other artistic work.

Industrial Property

It describes the physical matter that is the product of an idea or concept for commercial purposes.

Major types of IP

There are 3 major types of Intellectual Property. They are,

  1. Patents
  2. Trademarks
  3. Copyrights

Patents

A patent describes an invention for which an inventor claims the exclusive rights. Term of patent is 20 years from the date of filing for all types of inventions.

Trademarks

A trademark describes a symbol, logo, sound, color, design or other device that is used to identify a business or product. Term of trademark is 10 years from the date of application.

  • TM : Temporary trademark for product
  • SM : Temporary trademark for service
  • R : Registered trademark

Copyrights

It protects the expression of an idea, Not the idea itself. Term of copyright is author's lifetime plus 50 years from the calender year in which the author dies.

Infringement

Any work is used without the permission of the inventor or creator is infringement and IP protects the creators work from infringement by punishing the copyers.

Conclusion

  • No comparisions that are likely to cause confusion.
  • Do not use competitors mark that would harm competitor.
  • Create yourself, rather than using the others creation.
  • Mention the courtesy for using other's work.
